http://news.yahoo.com/s/ap/20090109/ap_on_go_co/pay_equity The Lilly Ledbetter Act "The Paycheck Fairness Act puts gender-based discrimination on an equal footing with other forms of discrimination in seeking compensatory and punitive damages. It also puts the burden on employers to prove that any disparities in wages are job-related and not sex-based, and bars employers from retaliating against workers who discuss or disclose salary information with their co-workers." The lawyers are saying cha ching! As are the unions: Employee Free Choice Act : "Business groups maintain the Employee Free Choice Act is an affront to democratic principles. Unions say companies have used secret ballots to intimidate pro-union workers and that the bill could help reverse the downward trend in union membership"Ask a goat: this is straight out of the headlines, perhaps you should spend less time listening to Hannity because I certainly don't. moreOpen Question: How do we go about adopting a friends baby?

I had contacted several lawyers disability today about disability denial appeal for my 3yr old son. I sent her the paperwork from my son's teacher and speech therapist. His teacher wrote in some of the things that affect his everyday llife. I applied for disability for him because he needed it to go to the school he goes to its for infants and toddlers with special needs. My job insurance(KaiserPermanente) doesn't cover this school its only for kids on low income or ssi(medicaid). I had started working before I found that out. One lawyer told me to file the appeal for myself. She said I didn't need a lawyer because he's a toddler they were going to deny him the first two times I filed they usually do. She said no need in giving up his money to her for something I could do myself she already knew the outcome. I contacted a second law firm I talk to another lawyer she had me fax over my sons paperwork from his teacher and speech therapist. She said her law firm recommend that I drop the case because in their opinion his disability wasn't severe enough its only a speech delay that not considered a disability ssi and there is no need to fight for it he going to be denied. But his teacher wrote that he was not up to par with children of his age group. Should I appeal the case on my own like the first lawyer said? Should I not appeal like the second lawyer said becuase it not worth fighting for since he gonna be denied anyways? Is speech and language an actual disability or not? I only have 3wks left to file an appeal. Thx in advance for the advice. moreOpen Question: Moral dilemma: What would you do?
A madman who has threatened to explode several bombs in crowded areas has been apprehended. Unfortunately, he has already planted the bombs and they are scheduled to go off in a short time. It is possible that hundreds if not thousands of people may die. The authorities cannot make him divulge the location of the bombs by conventional methods. He refuses to say anything and requests a lawyer to protect his fifth amendment right against self-incrimination. In exasperation, some high level official suggests torture. This would be illegal, of course, but the official thinks that it is nevertheless the right thing to do in this desperate situation. Do you agree? If you do, would it also be morally justifiable to torture the mad bomber's innocent wife if that is the only way to make him talk? Why?You don't have time to send him anywhere, nor time to evacuate and probably cause a panic in the city. moreOpen Question: What would you do when it comes to taking family to court?
A girl is beaten up badly and regularly by her brother who is 10 times the size of her... only ever when he's drunk. And his excuse is that he was drunk and she irritates him. So she gets so scared one night after being beaten severely and calls the police. They come, she begs them not to arrest him because she knows her family will give her crap for it and talk her down... and they say that because of the sitation, they have no choice. So now he has to face her brother in court. So her family slanders her, threatens and verbally abuses her, gives up and offers her money to shut her mouth. She refuses and says she cannot deal with it anymore. They get angry and tell her that she's ruined his life forever. That they hope she is proud of herself that she has screwed up his life. They then tell her that they will hire him the best lawyer and when he wins, she is never to come in contact with them again. So now she has a choice: Drop all charges and keep her family or continue to press charges and lose her family forever. What would you do?Just wanted to know everyone elses thoughts..I'm actually 19. To be honest, I think I'm doing it more to get revenge for all the times he hurt me and they allowed it. I want them hurt. I'm very well off financially, have my own car, studying system engineering.. I'm capable of living without them. I guess when they called me vindictive, they were right. moreOpen Question: Do you think this is right?

Today my ex husband calls and says he wants to give up his rights to his boys. One is 7 and the other is 4. He has done some bad things in the past like leaving them at home alone, not feeding them, not having money to feed them, neglecting to pay attention to them, etc. He is also 950 in the hole in child support right now and climbing. As I tried to talk him out of this he believes it is in the best interest of the boys and wants this done asap. Although I know what this means, is it possible for him to give up rights as he so easily wants to do? As an individual goes through an experience in which it causes them to mature, the result is usually an increase of intelligence, such as determining good from evil; right from wrong. Such a person goes through a transformation in a play called The Crucible, by Arthur Miller. Through a series of executions Reverend Hale changes from the force behind the executions, to the defender of the innocent. When Hale was first introduced to the play, he strictly followed the law to maintain order, and his actions resulted in contributing to the witch trials. For example, Hale first entered the play to help Parris’ niece break free from a “spell” that was cast upon her, and also arrives with many books which are “…weighted with authority.”(pg 34) Hale sets his mind on ignoring any facts or opinions based on emotional thought by having his law books to guide him. Also, when two Christian women, Martha Corey and Rebecca Nurse, get accused of witchcraft, their husbands defended their wives and argued with the case, but Hale defended the court: "I have seen too many frightful proofs in court - the Devil is alive in Salem, and we dare not quail to follow wherever the accusing finger points!'"(pg 68) Although it is ridiculous that two God-praising citizens are accused of witchcraft, Hale displays he contains greater faith in the court rather than his heart because he doesn’t show mercy to the accused. As the court proceeds with the witch trials, Hale first shows his oppositions to the actions the court takes. For example, Hale begs Danforth, the judge, to let Proctor return to court later with a lawyer while Proctor is being interrogated, but Danforth rejected the idea. Although Danforth possesses absolute power in the play, Hale for the first time fought against him. When the court went so far as to arrest Giles and Proctor, Hale quit the court: "`I denounce these precedings! I quit the court!'"(pg 115) Hale can no longer accept the decisions Danforth, and the accusations finally reach a point where even Hale finds it to be ludicrous. After his decisions of quitting the court, Hale then realizes his mistakes. For example, Hale vows not to take the life of an innocent person: "... I am a minister of the Lord, and I dare not take a life without there be proof so immaculate no slightest qualm of conscious may doubt it"(pg 95) Hale understands that the evil in the witch trials weren’t in the “witches” themselves, but the hunt to exterminate all of them. When John Proctor was given the choice to confess and live, or deny it and hang, Hale tells Proctor’s wife that life is the most important gift we have received: "It is mistaken law that leads you to sacrifice. Life, woman, life is God's most precious gift; no principle, however glorious, may justify the taking of it..."(122). After Hale contributed to the annihilation of innocent people, he realizes just how important life is, and how it cannot be wasted. He recognizes his mistakes, and demonstrates his change by trying to protect the ones undeserving of death, and his emotional affection to the trial. Hale changes from supporting the witch trials to stopping it because of the innocent people involved, and how much danger they’re in. Reverend Hale is capable of seeing his evil and sins revolve around him, and display his “maturity” to standing up for what’s right. The executions have opened the eyes of Hale, have helped him learn from his mistakes, and helped Hale get stronger. moreOpen Question: I've read on here that some were able to unlock their records for medical reasons?
Is that true? Does it take a Doctor to be able to do that? A lawyer? I I would think in those circumstances that a doctor or lawyer could facilitate to get that information if nothing else--even if the natural parents refused personal contact. It seems like 3rd party facilitated in the case of medical emergency would be a "safe" place to start for reform--and most really couldn't argue with it. It isn't great, but maybe a start that helps open the door. moreOpen Question: i am trying to get a divorce and i have no idea what to do?

hello! i recently returned home from a business trip to find my condo covered with surface mold! it ruined everything, my whole wardrobe, furniture, home office equipment etc. even worse, after 5 emergency room visits for breathing problems and dumbfounded doctors that couldnt find a diagnosis, they now attribute it to previously unseen mold behind the walls! i was renting a nice condo and brought it to the landlords attention, his response was that i must have done somthing to cause this? he would not allow me to break the lease! so i filed a complaint to the health dept asking them to investigate the issue, subsequently they told me this was the worst case they had seen in 10yrs!!! they made requests to the owner to remediate ie. clean it up! in which he refused! then, for some reason the health dept rep backed down from them as i think they knew each other! the owner summoned me to court for an eviction. i went to the property mgr to pay the rent on the first of the month and they said they could not accept it? they then waited till the 5th of the month and filed an eviction against me! i took lots of very graphic pics of the amounts of mold that were unbelievable! while waiting in the hallway of the courthouse i asked the baliff if my name was called? he said oh yea! we did call it and we issued a 5 day set out date? in other words, get out in 5 days for not showing up for court! i even subpeonaed the health dept. dude and his findings to prove my case! so within 5 days i had to vacate the condo! my rent was 1,100.00 mo., i agreed to pay an money and they refused, but then evicted for non payment of rent? they always accepted any rent late etc, but in this matter they were angry over the mold which after doing my homework and talking to some neighbors and tenants moving out, they had horrible mold issues next door!!! in fact i found out there was a flood some years back and water stayed under the structure etc. the month that i made the water complaint the mgt. printed up a mold release to force people to sign to releive themselves of liability! even worse, my renters insurance doesnt cover this mold mess! i got royally screwed! evicted! im trying to find a lawyer and talking to the courts etc. to get this straightended out! my long winded story ends with, HOW WILL AN EVICTION AFFECT MY FUTURE ATTEMPTS TO RENT OR PURCHASE PROPERTIES? i know its negative, i live in ohio and the the due process is terrible for tentants/laws, in fact people are suing as its flat out unconstitutional to evict people like this, if i appeal, i still had to uproot myself, my property etc. obviously i need a lawyer, im not sure what kind? will the eviction be only on a local record check? my credit? can i explain this away? thanks moreOpen Question: My boyfriend has herpes but I dont. Can someone tell me exactly the procedure for taking a tenant to court? And what forms I need? I prefer not to go to a lawyer as they are costly, and so I wish to do this my self.I have already gone to the local courthouse and they told me to go get an Eviction Kit, but there are numerous forms in that kit, and I don't know which one to fill out etc. Other than that, they told me that since I am not a lawyer, they cannot advise me. I have a twin brother. And all through high school, and all through college, whenever I was about to break up with a girl anyway, I would always let him impersonate me one time before the breakup, to get sex from the soon-to-be dumped girl. He'd do the same for me. The girls never knew, so no harm was done. Yet we ended up getting to have sex with more girls than we otherwise would have. Then we both got married, and after that we swapped wives a couple of times, without the wives knowing it. But recently, he got a DUI, and had to join AA. And one of the steps in their 12-step program is that he has to apologize and make amends to anyone he's wronged. Long story short, he wants to confess to his wife that I had sex with her. She's very conservative, and very religious, and would almost certainly consider our little wife-swapping adventure to be some sort of rape. AND she works for the local DA's office (not as a lawyer, just as a secretary. But still...) My wife and I are divorced, and she lives in another state, so I can't really use any "if you tell, I'll tell" type of defense. I certainly can't go to prison over some silly, innocent little hijinks. So I guess my question is, is there some way out of this, other than having to kill my idiot brother? moreOpen Question: I want to be a lawyer?

Say a group of people were witness to a crime and you overheard them talking about it after it happened. You tell the state and a coordination goes on to interview these people about what they were witness to. Say each of these people did not mean to have witnessed said crime and agreed not to tell. Odds are they are going to ask for a lawyer at some point and, assuming they get a public lawyer who they do not ask specifically for, he is supposed to give them advice on whether to tell or keep quiet. You already hired a lawyer and asked him to "consult" or negotiate with these people and convince them that releasing the information is the correct thing to do, and in turn solve the crime. My oldest son who is 27 now has always been somewhat a black sheep in the family. We have never outcast him or anything. We have always accepted and respect him and try to work with him. He is a very intelligent person but he’s lazy and he has never really done well in school, he often just barely pass classes he doesn’t like and get a decent grade in class he like. He end up drop out just before he was sixteen to obtain a GED and enrolled into community college. He eventually finishes law school and became a lawyer when he was twenty four years old. We finally though he has changed and we were so happy about him. But last year, he quit his career as a lawyer to pursue mixed martial arts fighting career full time and become a photographer. Not long after that he dumped his girlfriend who used to be a cat walk model for a girl who has done some model for suicide girl website. My son also ends up get a tattoo of fallen angel wings that took up his almost entire back. Last time we went to visit his hometown, we were shocked to find out that most of his friends who aren’t professional fighters are really creepy. Some of them are even Satanists. Many of them stand out like a sore thumb, many have weird hair, tattoos all over, piercing and other things. Also in his house, he has some Buddha statue and pictures on display. This really disturbs us since we are a Christian. What could happen that changed my son so much? He threw away his job as a lawyer to be a photographer and fighter, he left his wife who uses to be a model for a weird girl, he abandoned religion he was brought up in for Buddhist, and he got tattooed up. We thought it all ended when he became a lawyer but now we’re uneasy about what he’s doing. moreOpen Question: prestige survey, answers appreciated?

can't remember the friggin name. someone help me out here. moreOpen Question: why did he ask for money when we already took care of the damages?
okay. so about three weeks ago my mum accidentally sort of crashed into our neighbor's fence with her car. [she just started driving so she's crap. lol] so then the neighbor told us he found a carpenter to repair it and it would cost 300 nzd but my mum found a carpenter who was a friend of a friend and he only charged us with 60 nzd. AND NOW. i hear from my mum that the neighbor was asking for 500/300 nzd because of the fence. why would he be asking for money when we already took care of the fence? its already fixed. so why is he asking for money? they were texting and my mum was like, "but i already paid for the repairal. and it didnt come from my insurance" and bla bla bla. then the neighbor was like, "that's ok. so now i would like to get in touch with your lawyer." what the heck? what does he want??? [we're really clueless about a lot of stuff here cause we just migrated]lol sorry if i got the category wrong. i dunno where to put it moreOpen Question: workmans comp. record?
My friend got hurt at work (2 yrs. ago). She then hired a lawyer and sued her employer. The case is over with now. How likely is it for her to get hired at another company now that this is on her record? moreResolved Question: When a conservative loses his job, does he automatically become a liberal?
Conservatives have a very romantic view of the differences between themselves and liberals. Conservatives view themselves as hard working, self-reliant, morally straight individuals who worked for what they have and don't expect a handout. Some are business owners who may even hire liberals on occasion. Conservatives view liberals, on the other hand, as minimum wage workers who get fired a lot, or welfare cheats and homeless people who expect government to give to provide for them, or members of protected classes like auto workers or teachers. A liberal may be wealthy, but a wealthy liberal inherited his wealth or came by it immorally (trial lawyers, politicians, Hollywood actors for example). But the economy has lost a net of 2.6 million jobs in the last year, so some conservatives must have lost a job or a business and can't find new employment. This is tragic, so please don't think I am making fun. They may be receiving unemployment, or they may be doing odd temp jobs. Some may have lost their homes to foreclosure, or are a candidate for one of the foreclosure bailout programs. So are we creating a whole new class of liberals right now? Or do even conservatives sometimes have bad luck not entirely of their own making and need help from time to time? I am asking this seriously, so please rant if you like, but I really want to know what conservatives think. moreWelcome to Lawyers News
